1. Binding Agreement & Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and ATOM FORGE (founded and operated by Suresh Ganesen, "Company", "we", "us", or "our"), governing your access to and use of Atom Forge Studio, Atom Studio AI, Class Mode, cognitive reasoning engines, and related services (collectively, the "Service"). By creating an account, signing in, clicking "Start wondering", or accessing any portion of the Service, you signify your full agreement to these Terms. If you do not agree, you must immediately discontinue use of the Service.

2. Eligibility & Age Requirements

The Service is strictly available to individuals who are at least thirteen (13) years of age (or sixteen (16) years of age for residents of the European Economic Area or United Kingdom under applicable data protection laws). If you are between 13 and the age of majority in your jurisdiction, you represent and warrant that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Nature of AI Output & Strict Disclaimer of Inaccuracy

3.1 Artificial Intelligence Limitations: Atom AI produces text, calculations, slide presentations, and analytical evaluations based on probabilistic algorithms and third-party frontier language models. By using the Service, you explicitly recognize that:

• Atom AI is an artificial intelligence that can make mistakes, omit critical nuances, or produce erroneous facts.
• No output generated by Atom AI represents a guarantee of truth, precision, or suitability for any real-world purpose.
• You are solely and exclusively responsible for reviewing, testing, and verifying the accuracy and appropriateness of any generated code, academic solution, or scientific deduction before use.

3.2 Strict Professional Disclaimer: The Service is NOT a licensed healthcare provider, certified legal counsel, registered financial or tax advisor, or licensed professional engineer. Outputs MUST NOT be relied upon for emergency situations, clinical diagnosis, investment decisions, or engineering certification.

4. Academic Integrity & Responsible Use

Atom Forge Studio provides educational tools (such as Class Mode lecture summarization and interactive slides) to assist in conceptual understanding and study. Users are solely responsible for ensuring their use of the Service complies with the academic integrity policies, honor codes, and examination rules of their respective schools, colleges, or universities.

5. Intellectual Property & User Content

5.1 Ownership: All proprietary software, custom neural weights, algorithms, user interface designs, logos, and trademarks associated with Atom Forge Studio and ATOM FORGE are the exclusive property of Suresh Ganesen and ATOM FORGE.
5.2 User Content: You retain all ownership rights in the queries, texts, and documents you submit ("Input"). You grant ATOM FORGE a limited, non-exclusive, worldwide license to process and transmit your Input solely for the purpose of operating, maintaining, and delivering responses to you.

6. Prohibited Activities

You agree not to use the Service to:

• Violate any local, national, or international law or regulation (including in the USA, UK, EU, Malaysia, or Singapore).
• Generate malicious software, viruses, cyber exploit payloads, or unlawful content.
• Infringe upon the intellectual property, privacy, or moral rights of any third party.
• Attempt to reverse engineer, decompile, scrape, or overwhelm the Service's infrastructure or rate limits.

7. Complete Warranty Disclaimer ("AS IS")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW IN ALL JURISDICTIONS (INCLUDING THE UNITED STATES, UNITED KINGDOM, EUROPEAN UNION, MALAYSIA, AND GLOBALLY), THE SERVICE AND ALL AI-GENERATED OUTPUTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

8. Comprehensive Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL ATOM FORGE, ITS FOUNDER SURESH GANESEN, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, ACADEMIC PENALTIES, WORK STOPPAGE, OR HARDWARE DAMAGE) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE. OUR TOTAL AGGREGATE LIABILITY UNDER ANY LEGAL THEORY SHALL BE STRICTLY LIMITED TO THE GREATER OF FIFTY MALAYSIAN RINGGIT (MYR 50.00) OR TEN US DOLLARS (USD $10.00).

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles. For users residing in the United States, you agree that any dispute shall be resolved on an individual basis via binding arbitration, and you waive any right to participate in a class action lawsuit or class-wide arbitration, to the fullest extent permitted by law.

1. Information We Collect

• Account Data: When registering, we collect your email address, display name, and securely salted/hashed credentials (or OAuth identification tokens when signing in via Google).
• Usage & Quota Telemetry: We collect non-identifiable usage statistics, query token volumes, active engine mode choices, and rate-limiting counters to allocate tier quotas.
• User Input & Uploads: Text prompts, lecture audio snippets, and attachments are processed strictly to generate responses and slide notes requested by you.
• Local Browser Storage: Theme preferences, active session lists, and draft notes are stored locally on your device via HTML5 localStorage.

2. Lawful Bases for Processing (GDPR / UK GDPR / PDPA)

We process your personal information under the following lawful legal bases:

• Contractual Performance: Processing necessary to provide you with the AI studio features, session history, and lecture note tools you request.
• Legitimate Interests: Securing the application against automated brute-force attacks, enforcing fair-usage quotas, and debugging performance bottlenecks.
• Consent: Explicit user consent provided upon account registration and continuing use.

3. Absolute Prohibition on Sale of Personal Information (CCPA/CPRA)

We DO NOT sell, rent, trade, or share your personal information with data brokers, ad networks, or commercial third parties for cross-context behavioral advertising. We have never sold personal data and will never do so.

4. International Data Transfers & Security

Your information is stored in secure, encrypted datastores. When transferring data internationally for cloud reasoning or multimodal processing, we implement standard contractual clauses and rigorous technical encryption safeguards adhering to EU, UK, and Malaysian standards.

5. Your Rights Under Global Privacy Laws

Depending on your country or state of residence, you have the following enforceable rights:

• European Union & United Kingdom (GDPR): Right to access your data (Art. 15), right to rectification (Art. 16), right to erasure / "Right to be Forgotten" (Art. 17), right to restrict processing (Art. 18), and right to data portability (Art. 20).
• United States & California (CCPA/CPRA): Right to know what personal data is collected, right to delete personal data, right to correct inaccuracies, and right to freedom from discrimination for exercising your rights.
• Malaysia (PDPA 2010): Right to access your personal data (Section 30), right to request correction (Section 34), right to withdraw consent (Section 38), and right to prevent processing likely to cause damage or distress (Section 42).

6. Data Retention & Account Deletion Requests

We retain account data only for as long as your account is active. To permanently delete your account, session logs, and personal data from our servers, simply send an email with the subject "Data Erasure Request" to sureshganesen95@gmail.com. All records will be securely purged within thirty (30) days.
